I was asked by a member if he would be able to post the following.
I agreed as I think it is important for potential purchasers coming to the área.

He has spoken to his lawyer about the posting and his lawyer has not advised him not to post his message:

Dear Nigel,
                 I have attached something that I would like to post on the forum but I am concerned that you might consider it defamatory. I went to see my lawyer, Tom Batlle on Monday and, after reading the relavent e mails and text messages, he suggested that I contact you.



I have also taken the oportunity to post an email I personally received following the 'Three Witches' posting last year. This posting was taken down at the request of a Miami Playa lawyer as it referred to three differnet parties. I must admit to being somewhat suprised to receive the email. I have also posted my reply.



I bought my house on 22nd November, 2013. Myspanishome were the estate agents. Steve and Stephanie were extremely helpful. They took me shopping and helped me buy a car. They live near me and I became friends with them. When I wanted some work done to my house I asked them for advice. They told me that they knew some fantastic Romanian builders who had completed their extension in nine days.

The builders were a nightmare; they kept on upping the price and the work was very shoddy. When I complained Steve and Stef organised a meeting and seemed to be on my side. In reality they were just keeping me in the project.

The work took months and when it became time to pay they were very much on the side of the contractors and, I'm ashamed to say, I was intimidated into paying what they wanted.

   I didn't want to be friends with them after this and they reacted  with great indignation.  They sent me the following bill. 


   The bill is ridiculous. Even if one gives them credit for the legitimate things that they did (ie going to the dog kennels) they are still, retrospectively, charging me 96 Euros per hour for activities that they volunteered to do. A few days later I got the following e mail.

resolve this matter.

Please understand that we will set this in motion on Monday 26th May 2014.
Please understand also that if this action is taken you will be liable for
our Lawyers costs.

We therefore hope this matter can be resolved without the above action being

   After that I had some threatening text messages from Steve and he made it clear that he wants to force me out of Tortosa. I have heard that they are spreading vile rumours about me.  For this reason, and because I want to help other newcomers, I think it's important that we take a stand and resist the bullies.

We also have three clients who were shown what was said about us on the Forum by other  Agents, but they still came to us – but we know that there will be lots more who did not!  The three have made statements regarding this – we will be seeing you in Court!

I will be seeing you personally on this matter for a cup of tea and a biscuit of course.  I thought you had more brains – you yourself have opened a can of worms – like I said before – I hope it was worth it.

You may or may not be aware but I was on holiday from 7th to 21st May, had no email and saw nothing that was written on the forum during this time.

I only today received a letter from David Pique and intended to investigate and call him tomorrow, I had to collect the letter from the post office this morning  – could you not call me directly?

I can assure you that all of the activities I carry out are legal and that I have been continuously registered as self-employed in Catalunya for the last 7 years, submit all my accounts and pay my taxes.

I do not and never will respond to threats. That is bullying, something I absolutely detest having suffered from it during my school days.

As for the people who posted their views, I have no control over then or what they write. Participation on the forum is open to anyone but each person is responsible for what they write.
The forum has 2 moderators and I do not spend my life reading every post, scrutinising it, editing it etc.

If you like I will happily post this on the forum pages for anyone to read as I have nothing to hide.

As for the advertisers, it is entirely up to them whether they are working legally or not. I do not police their legality. If they wish to advertise and work illegally then that is up to them.

I have copied in your solicitor as I understand that he speaks English.

Informative thread, Those wishing to move here would do well to study and understand it well. It is easy to misunderstand the motivations of people you may meet or whom may befriend you when you first move here. It can also save you a lot of problems to understand what the different reactions of people maybe when disputes arising from the misunderstandings come to  a head. It can be the difference between enjoying and not enjoying your new life.   :)

I published it as it was sent, complete with details. I didn't want to be accused of editing ot tampering.

As for the accusations against me, I did ask David Pique for details of all the supposed unhappy customers as I was totally unaware of them. As of now, over a year later, I'm still waiting and am still unaware of them...

Well, I now know who I will not be using to sell my property. The impression of good business practices has gone right out of the window with that threatening posting.
With regards to Nigel whenever he has done work for me before and since our move here in 2005 I have always received properly written invoices together with all the necessary legal registrations etc. that are required.

I think they have just shot themselves in the foot, no doubt with in 12 months they will be trading under another name, one thing is for sure in spain there are more hands in your back pocket than you need

Interestingly, despite claiming on their website to be "a fully registered property estate agency for Spanish Property sales in Tortosa and the surrounding areas of the beautiful COSTA DORADA" My Spanish Home doesn't actually provide that number.

Checking on the Agencia de l'Habitatge de Catalunya I couldn't find them either: http://www.agenciahabitatge.cat/wps/portal?WCM_GLOBAL_CONTEXT=ca/ahc/web/serveis/registreAgents/cercadorAgentsRegistrats#

I'm sure there's a reasonable explanation as all estate agents MUST register with that agency. Failure to register would leave MySpanishHome wide open to customer complaints to:

From what I understand (I'm not a lawyer) from reading the relevant legislation, there ¡s a fine of 6000 to 12000 euros for those who work as estate agents without registering.

Hmmm... Not too sure how good that Agencia page is - according to it, there are only 5 'Registered' Agents in L'Ampolla, and an agent that I know to be registered was not in the system, so as usual, I would not read too much into it.

Whilst I feel threats and bullying are despicable acts, in the interest of giving this thread  balance, it may be enlightening to hear  'another side to the story', if there is one.

I am not suggesting a trial by forum by any means.

A shame this old thread got edited, I posted a (non specific) warning about dodgy Estate Agents in Tortosa and the very same people we see here threatening a homebuyer, Nigel the TTF Admin and "all businesses who advertise on here" showed up in the thread and identified themselves as "fitting the bill" for the scumbags I was alluding to.

Somehow the phrase "shooting yourself in the foot" is not enough !

Strangely the same things appear to be happening again. Or maybe it is not so strangely, you can draw your own conclusions....

Fantastic work by snowhitsky, how funny it would be if they themselves got denounced and hit with a large multa, after threatening everybody else.

Please do not edit this thread Nigel, people need to be informed of what goes on around here.

i think you all should mind your own on this one .the two lots involved should be able to sort this matter out on there own and this post should not be on here at all how do we know what went on between mr Bailey and my spanishomes ...we dont...mr Bailey may have said he would pay for the services he got we dont know .all i know is myspanishomes have sold three propertys for us and we have also bought one from them so 4 dealings in total and no problems so come on give it a rest it gets very boreing at times.and i am pleased we have now got two propertys back in the uk so that we can get away from all the back stabing that gos on on here i have had my say so am now going

I'm sure there are many 'happy' buyers and sellers out there. From what I can gather even in the current financial climet they are successful in selling houses.

It is a pity that when things do not go their way they have to resort to threats, abuse and bullying tactics.

Anyone who deals with these people need to be aware that should things not turn out as expected then they may well become the recipient of similar abuse and bullying. I personally had no dealings with them and made no comment about them so the original email I received with all the accusations and threats was somewhat shocking and unwarranted.

I also just received an email from another buyer, a single woman who was forced to pay the sellers fees and then received abusive texts late at night and threats of denuncias.. here is her story..



This is one of the very very mild ones, threatening to denounce me re workers ; Im trying to find from xxx who worked for me as a sec the other emails and texts as I asked her to keep them on file.

They were much worse than this.

I am happy to make a statement re them if that helps
Essentially, they did not sign a proper agreement with xxxxxxx when he placed the farm with them for sale (I thought under Spanish law they were obliged to do that) and so when the offer was made etc they told me that I would have to pay the 10,000e commission as he would not.

I offered to pay half, under sufferance; xxxxx negotiated with them to pay only 3k so I ended up agreeing to pay 7000 WHEN we went to the Notary.
When I sent the deposit on the farm of 20,000e (to them) they deducted without my permission or xxxxxx 3500 from me and the 3000 from him, this was before we went to the Notary.

Then the sale slowed down, and before I moved to the farm I was receiving threatening texts on my phone, often late at night saying they were going to come after me in a really nasty way and all the things they had ‘found out’ about me.

No, I was not denounced (there was nothing at all wrong or defamatory in what I posted) and Nigel was cool with what I posted, but the posts did get edited later, so long ago I forget the specifics of why.

Using threats of violence against defenceless people may work at times, but it does not not always. Frequently you find it actually provokes others to get involved and the bully gets their just deserts.

10K comission! According to MySpanishHome:

For everybody's information MySpanisHome charge 5% or 6.000euros including 21% I.V.A for a property sale.  We give the sellers an invoice when the sale is completed.


If you don't mind me asking did you pay 200K for the property? And forcing the BUYER to pay the comission ????

What does it say ? That he has no axe to grind ? Do you actually understand this ?

Funny that you are still the only poster who has showed up to say a good word about these people. Threatening to leave the forum, or country if anybody dares to disagree with you has been almost as amusing as your spelling.

I spotted this as well - makes you think doesn't it.

If there was no truth in this, then I would expect someone from MSH to make a rebuttal, but in it's absence, I can only believe it to be true.

Assuming that the e-mails from them that have been posted on here are true I don't see what they can rebut.  They are clearly threatening in nature, and charging €480 for sourcing and having delivered a dog bed and kennel is just taking the pee.  10 hours work?  Really??  And charging for six hours work for 'introducing builders'.  What did they do?  Throw a cocktail party??

There has been a lot of comment on this, all that is required both in tone and content to make a decision as to whether to do business or not with these people is contained in their letter to Nigel. I fully agree with Nigel the best way to deal with this kind of bullying is to expose it.

I Don't understand some people, have any of the people meet Mark Bailey!!! well i have and let me tell you something that none of you know about this man, he come across very well and butter would not melt in his mouth, i will say one thing about Mr Bailey he has a very dark secret and a past that is going to catch up with him thanks to this forum he has been located.

I Can understand what Myspainshomes have done as he is a con and this is not the first time people have trusted Mr Bailey and he has lied and stolen in the past, so beware there is two sides of a story and by the sounds of it Myspainshhomes have tried to help him and Mr Bailey has been up to his old tricks again.

The people you need to explain on part of this matter is Myspainishomes! do MSH have accesses to this forum? and if not why, everyone has had a say so maybe wait and see what MSH have to say in relation to Mr Bailey do they have a right to reply i don't know

Maybe it is time to close this thread. The matters are over 12 months old and those concerned who wish to do so have put forward their views,Others have choose not to add anything.If these allegations were pending court the comments here on would be sub-judice.We do not know if matters are still "Live" or it's all hot air. The law states "Statutory contempt law bans the media from publishing or broadcasting, including on the internet, any comments or information that might seriously prejudice active legal proceedings "

The depth of emotional turmoil that has emerged from this story is heart-breaking and I sincerely wish that all concerned have a happy ending. Difficult enough as we all know, but it is so important for all of us who have made the quantum leap to a new life here to put past mistakes behind us and get on with our future. Easily said when one has a potential lawsuit aimed at them (as evidenced in the introduction to the story) but many of us have had the pee taken by ex-pat "professionals" and by nationals alike and I hope this has made us stronger people. I have wanted to comment on this article for a long time but not felt it my place, however I absolutely agree with Bunter that it is time to stop. The real villains have taken advantage of people who have trusted them and now try and bully their way out, especially when they are challenged. I wish all who have been on the receiving end of their threats a swift and successful outcome.

I can understand what Bunter & Betty are saying, it is not nice to read what has happened to people who have moved here. However it is a fact that this has happened and that there are people around who would engage in this kind of activity. It is a duty to enlighten people of the dangers inherent in making the move. It is the best way to ensure they will have a happy time.
I have been helped to avoid many problems by reading and getting advice on the forum.
We need a happy community and one of the functions of the forum is to promote this including detailing the activities of those in the community who would seek to take undue advantage of others.
I agree that those who have had problems should try and put it behind them and enjoy their life here. Having this on the forum
should allow them to know that they have not bowed down to this type of exploitation and helped others to avoid similar problems for others.

After having a chat with MSH on other matters, and i did ask about this matter in clear detail and to be honest the Forum has been Judge and Executioner on this matter.

We can all be Judge and Executioner when its only one sided i can not believe how shallow minded people can be, this is a case of a couple of people on a witch hunt as i have been told the real story and to be honest this forum is being used and controlled in a way that MSH can not have a say.

So lets all be fair about this i am sticking up for MSH because i now know the truth in relation to the 2 cases on this, so my challenge would be let MSH have there say because MSH is being blocked from this forum from having a say by the admin of this forum.

So whats it going to be, carry on being judge and Jury & Executioners or push admin of this Forum let MSH have a say or is this going to put the 2 peoples that this involves nose out of joint.

You all need to know that MSH has been in business for 10 years plus and sold a lot of homes to a lot of happy people.

MSH are not blocked from the fórum. If their account has not used for 12 months then (as with all accounts) it gets deleted. This is to keep membership current and for no other reason. If their account has been deleted they are free to re-register.

Personally I would love to hear the reason they emailed me and tried to bully and threaten me. Bear in mind that I have personally never posted anything about them or have had dealings with them so their unilateral attack on me left me shocked.  Accusations of working illegally (total rubbish), unhappy customers (I have absolutely no idea of who they may be), threatening any and all advertisers on the fórum, 27 supposed affidavits against me - what!! I've never seen or heard of one so I can only asume they are nothing more than invented lies as if there was any truth I'm sure I'd be aware of at least one.

Threats of court, tea (don't drink the stuff)....

As I unhappily know from personal experience at school a bully will always try to justify his actions and many people are afraid to stand up to the bullies prefering to suffer in silence.

The emails posted are not gossip or hearsay but things written and sent to intimidate.

Does it matter who Mark Bailey is? Does who he is justify bullying him?

My bullies justified themselves;
Nigel doesn't like rugby - excuse to bully
He is a day boy - excuse to bully
His dad isn't a doctor/solicitor/lawyer but a gas man - excuse for bullying
He's interested in electronics - excuse for bullying..

So the list goes on.

Hahaha, I don't know the agency personally but seriously, what did you think they were going to say?  As Nigel has said they aren't banned and they haven't been prevented from having a say if they want to.  I would genuinely like to read their side of this.

As for 'moving on' or 'putting it behind you' it's a bit trite isn't it if you believe that people who have treated you badly or threatened you unnecessarily to just roll over and say 'never mind' if and when you allegedly see it happening to someone else?

Pondgirl, I am not sure what you mean. Ian Bailey & Nigel have done a very effective job by publishing this behaviour. (& well assisted by MSH.). I do not see any "roll over" or "never mind".
Further this information is now available for "someone else" to see when they do their due diligence. Therefore your "trite" remark does not apply in this case.

I obviously didn't express myself very well.  I agree with what you are saying, it was because it was being suggested by others that this thread be closed as it was a long time ago (?) or that there is a pending court case that could be prejudiced and that people have to move on.

Seeing as this is actually Nigel's forum and he took legal advice before posting I have no problem with the thread being left up.  I don't know what people are afraid of.

Why should he have to do that?  If MSH are putting about rumours that someone is a paedophile or breaking employment laws or whatever they should be denounced, prove what they are saying is true, or be sued for slander/libel.  These kind of accusations can have life-breaking consequences.  And to be honest, even if someone were a paedophile or bank robber or rapist I would still find them being threatened for business reasons utterly despicable.  If you have good reason to believe that someone is a threat of some sort you should at the very least confront them with it  or go to the police, not try to gain financially from it.

I'm not often shocked at bad behaviour but if any of this is true, and I would still like MSH to respond, I certainly wouldn't recommend MSH to anyone thinking of buying or selling, indeed I would actively point them away.

.....  as well as inventing and spreading vile rumours about one of their disgruntled clients - MSH also threatened him, and presented him with a bill for services that they volunteered to do. Very professional. Not!

Mark Bailey is a hero for standing up to them. But I suggest he seeks legal advice regarding prosecuting them for slander and compensation.

Essentially, they did not sign a proper agreement with xxxxxxx when he placed the farm with them for sale (I thought under Spanish law they were obliged to do that) and so when the offer was made etc they told me that I would have to pay the 10,000e commission as he would not.

I offered to pay half, under sufferance; xxxxx negotiated with them to pay only 3k so I ended up agreeing to pay 7000 WHEN we went to the Notary.
When I sent the deposit on the farm of 20,000e (to them) they deducted without my permission or xxxxxx 3500 from me and the 3000 from him, this was before we went to the Notary.

Then the sale slowed down, and before I moved to the farm I was receiving threatening texts on my phone, often late at night saying they were going to come after me in a really nasty way and all the things they had ‘found out’ about me.


Well well, the above statement is just a load of rubbish and you should all take note that this woman has slagged of MySpanishhomes estate agents lied about them and lied to all of you too, this woman if a con and a thief and she tried to do the same to MSH but look don't take my word for it read for your self:   Her name is Wendy Smart go on to www.olivepress.es ;  go on to search box and put in Wendy Smart and then you can all make your own minds up. she is not that smart as her has done it there and now she is doing the same at Xerta
