CONSUMER ADVISE

Hi all could someone give us some consumer advise we brought a water pump from leroy merlin
in august this year and it failed a short time later in october so when we were recently over i returned
it to leroys who were not very helpfull after a long struggle with the staff we were told they were not responsible for the warranty which is 24 months and they gave us the number of the pump manufacturer
in barcelona to call, which i can see will turn into a saga as we do not speak catalan and we will probably not bother so any ideas appreciated and are leroys not responsible in any way

I'm no expert on this but my feeling is Leroy Merlin are 'trying it on'. I would have thought consumer rights are pretty similar throughout Europe as we are all dealing with multi national companies  these days. There is no doubt that in the uk the shop you bought the pump from would be liable to either re-embuse you, fix the pump on your behalf or give you a refund.
I think you should go back to Leroy Merlin and insist that they provide you with the name and contact details of the store manager. You can then write to him in Spanish ( maybe you know someone who can help with this) and make a formal complaint. Find out what the equivalent of 'trading standards' over there and tell the manager that you will be contacting them if the matter is not resolved.

Try what my friend did recently in Bauhaas.
The staff could not exchange as they did not have the same model in stock so he demanded a refund.  Was told that this was no longer their policy since August, which happened to coincide with the date the product was bought - very convenient.  He was a offered a credit note instead for other products.  He told them that was not acceptable and demanded his money again.  This was promptly refused once more and stayed that way until he demanded to see the store manager immediately.  Surprise, surprise they were suddenly able to refund the money.  They obviously had a set procedure to adhere to until they realised that they were not going to get away with it and bringing out the store manager was obviously going to get their knuckles rapped.

I had exactly the same problem with a water pump bought from leroy's and it had the 24 months warranty. we took it back to
leroy's and they didn't have the same model anymore so i asked if i could buy a different one and pay the difference - no
problems there either

You could call the 'Agencia catalan de consum' their number is 012 or www.consumcat.net. I don't know if they have any English speakers but it's probably worth a try.
I'm sure they will tell you your rights, and if you tell Leroy Merlin you have spoken to them I'm sure you will get some response.

I have often used this number for friends and self for all sorts of issues and you just ask for an English speaking person and they are very fluent and have sorted out all sorts of challenges. Been using them since 2004!
